What is Small claims track?

The court track for most claims up to £10,000, designed to be used without a solicitor.

Defended money claims are allocated to a "track". Claims up to £10,000 normally go on the small claims track, which has simpler procedures and an informal hearing. The key rule: the winner usually cannot recover legal fees from the loser — only the court fees and limited expenses.

Claims above £10,000 go on the fast track or intermediate/multi-track, where legal costs can be recovered (and lost).

Example

A £6,000 defended invoice claim is heard on the small claims track; each side pays its own legal costs.
